About 2 years after a 60-day Notice of Intent To Sue filed by Save the Dunes Conservation Fund and others, the Indiana Department of Environmental Management (IDEM) is proposing preliminary adoption of 401 & Wetland Water Quality Rules next week. Our notice was for the lack of a properly approved 401 program. The wetland rules were added to the package. While not perfect, these rules will be a base for protection and for public input into 401 decisions.
IDEM has completed revisions to the draft wetland water quality standards and 401 Water Quality Certification procedures based on comments received during the second notice period. The preliminary adoption hearing will be held June 14, 2000 at the Indiana Government Center South in Indianapolis. Copies of the draft rules and responses to comments are available from the website: www.state.in.us/idem/owm/planbr/wqs/rule_and_procedures.htm
